Trump’s government has asked the DC Circuit Court to remain the decision of the James Boasberg District judge who temporarily blocked the government from deporting Venezuelans using the alien enemy law.
The White House argued that Boasberg did not have a jurisdiction to enter the temporary detention order, which was described by the administration in submitting the appeal court as “never before.”

The government argues that Trump’s actions in asking for AEA “are not subject to the Judicial Review” and that “there is no legal basis” for the court to order the implementation of the President’s proclamation.
“If this tro is allowed to stand,” wrote Doj, “District Court will have a license to order almost all urgent national security actions after receiving naked complaints.”
The DC circuit ordered a response to the emergency motion to remain submitted on Tuesday at 17:00 by a lawyer representing the plaintiff in the underlying case.
