Grand Jury Federal has returned the indictment that demands Rep. Lamonica Mciver was allegedly attacking law enforcement officers outside the immigration detention facility last month, officials announced Tuesday.

The charge of three counts accusing members of the Democratic Congress by “Forcibly Harrifies and Disrupts Federal Law Enforcement Officers” at the facility, US Prosecutor New Jersey Alina Habba said in a post in X.

“As I have stated in the past, it was my constitutional obligation as the Head of Federal Law Enforcement Officers for New Jersey to ensure that our federal partners were protected when carrying out their duties,” Habba said. “While people are free to express their views to or oppose certain policies, they may not do it in a way that endangers law enforcement and the community served by the officers.”

This indictment is a standard procedural step after the Habba office demands Mciver through a criminal complaint last month.

Mciver has vowed he will fight accusations and plans to claim to be innocent.

“The facts of this case will prove that I only do my job and will expose this process for what it is: efforts to bold political intimidation,” he said in a statement about X. “This indictment is no more justified than what I will not do.

If it is proven, the maximum sentence for accusations in the indictment ranges from one to eight years, said Habba.

Baraka was arrested at the facility and was charged with committing a violation, even though Habba then canceled the indictment.
