Abrego Garcia received a protective court order in 2019 which prohibited him deported to El Salvador for fear of his safety. Van Hollen traveled to El Salvador last week and met with Abrego Garcia, whose wife was a US citizen and Constituent Van Hollen’s, on Thursday after initially rejected access.

Van Hollen stressed that for him, this case was about protecting constitutional rights, telling Karl, “I did not defend the man. I defended the rights of this person for the process he should.”

But Homan maintains the government’s actions so far, with the reason that under the Enemy of Alien 1798, the government asked to deport hundreds of Venezuelan migrants including Abrego Garcia, the right to be more limited.

“I support the facts, I think we do the right things here. We eliminate the threat of public safety, national security threats, cruel gang members from the United States,” Homan said. “We have followed the constitution. We have followed the law. Homan’s defense of the centuries of the law in his Friday interview came only a few hours before the Supreme Court while stopping its use to deport every Venezuelan who was detained at a facility in North Texas.

Karl pressed Homan on the rights of the legal process of non -deported immigrants, quoting Flores 1993 v. The Supreme Court Reno written by conservative judges Antonin Scalia who recorded, “It has been well determined that the fifth amendment gives an alien title for the deported legal process.”

Homan also denies that every migrant is labeled with gang members solely due to tattoos. On Friday, Trump posted a photo on social media about what he said was Abrego Gracia’s hand. The MS-13 symbol seems to be accumulated and it is unclear whether other tattoos have a link to the gang.

“Tattoos are one of the many factors that will determine someone in the gang. That is not the only one,” said Homan. “What I said was that you could not ignore the tattoo. That is, that’s one more factor that makes you believe that it might be a gang member. It is not based on tattoos. This is based on many other things, but tattoos, one of many. But nothing is deleted just because of the tattoo.”
