The Department of Justice submitted a notification on Wednesday that they would appeal on the orders of a federal judge who required the government to facilitate the return of Kilmar Abrego Garcia who was deported in a wrongly deported from El Salvador, on the same day he released two documents that were previously accused of binding it to the MS-13 crime gang.

Two forms of government were present as evidence – gang field interview sheets from the Prince George District Police Department in Maryland and additional forms from the Department of Domestic Security – suspected affiliation of the Abrego Garcia gang about clothing and information from secret informants described as “proven and reliable sources of information.”

The report did not provide other information outside of clothes and secret informants to justify the claim that Abrego Garcia was a member of the ranking gang.

Abrego Garcia entered his second month in a Mega El Salvador prison after he was deported there on March 15, even though the 2019 court was issued forbid his deportation to his home country for fear of persecution.

His lawyer and his wife denied that he was a member of MS-13, and his lawyer had questioned the validity of the document by accusing the detective who wrote it was then suspended.

Assistant Secretary of DHS Public Affairs Tricia McLaughlin told ABC News’ Jay O’Brien on Tuesday that Abrego Garcia’s deportation to El Salvador was the result of “cleric mistakes” and that “he should have been sent to the Detention Center in Mexico, Nicaragua, Egypt.”

According to the Geng Field Interview Sheet – A Police Interaction Report with Abrego Garcia – He was approached by the police in 2019 after they said he was roaming in the parking lot of the house depot in Hyattsville, Maryland.

The report noted that Abrego Garcia was wearing a hat and hoodie Chicago Bulls which was decorated with the rolls of money that covered the eyes and ears of former US president, who according to the police bind Garcia Abrego to the gang.

“Officers know that such clothes are an indication of the cultural Hispanic gang,” said the report, noting that the meaning of the clothes was “not seeing crime, not hearing crime and saying no crime.”

“Wearing a Chicago Bulls hat states that they are members who are well-reputable with MS-13,” the report said.

According to the report, officers contacted “proven and reliable sources of information in the past” which said that Abrego Garcia was a member of the MS-13 rank. Abrego Garcia has the rank of “CheQuo” and has a moniker “Chele,” according to the informant. According to DOJ, CheQuo is a low-level MS-13 member.

The DHS report added that Abrego Garcia had $ 1,178 at the time of its arrest.

The report noted that Abrego Garcia was in the company of three other people when he was arrested, one of them, according to the police, had a broad criminal history and was known as an active member of the gang. Others are associated with MS-13 based on confidential sources, the report said.

The police said they could not connect a third person to the gang, writing that “MS-13 gang members were only allowed to roam around other members or prospects for gangs.”

Other Documents-Formal DHS I-213-Quoted Interview Sheet Prince George District Police Department to claim that Abrego Garcia was “identified” and “validated” as a MS-13 member. Abrego Garcia denied having information about human gangs or smuggling, according to DHS reports.

An immigration judge who denied the Garcia Abrego ties in 2019 cited both reports as the main proof to conclude that he raised risks for the community.

Lawyer Abrego Garcia has highlighted clear inconsistency in the DHS report, saying he offered a conflicting assessment of whether Abrego Garcia was afraid to be moved to El Salvador.

His lawyer also highlighted that the secret information connected Abrego Garcia with the western click of MS-13, which mainly operated on Long Island, where they said he never lived.

The report also noted that the two other alleged gang members in the home depot parking lot were members of different MS-13 clicks.

The development of Wednesday occurred a day after the US District judge Paula Xini ordered government officials to testify under oaths because, he said, they “did nothing to help in the liberation of Garcia’s abrego from detention and returned to the United States,” even though the Supreme Court directed Trump’s administration to “facilitate the ‘Abrego Garcia exemption from the guard at El Salvador.”

Per order to Judge Xinis, Trump’s administration on Wednesday submitted an update on his daily status in Abrego Garcia, saying that “There is no further update.”

“Given the clear and firm notice of the government to the court on how the government will facilitate the return of Abrego Garcia in the contour of the existing law and regulations, there is no further update,” Joseph Mazzarra, general advisor to the Department of Domestic Security, said in the renewal.
