A Salvador man accused of US Attorney General Pam Bondi to become the main leader of the MS-13 Gang asked the judge not to stop the criminal case against him, even though the initial Judiciary was trying to end this case in order to deport him out of the US.
Henrry Josue Villatoro Santos, who was allegedly in the US illegally, asked judges in the US District Court for the East Virginia district to postpone the dismissal because he was worried that the US government would soon move to deport him to Cecot El Salvador prison without opportunities for the proper process.
Villatoro Santos was arrested at a residence in Virginia on March 27 in a highly published morning operation. After he was detained at an extraordinary immigration administration warrant, the search for his room produced weapons and “indications of the MS-13 association,” according to a written statement from the US Immigration and Customs.

Attorney General Pam Bondi, Center, said the US arrested the top MS-13 gang leader on Thursday, March 27, 2025.

Director of Bondi and FBI Kash Patel attended during the early morning attack. At the press conference on that day Bondi said the man arrested in the operation was “one of the top leaders of MS-13” and “East Coast Leader” for gangs. “He will not live in our country even longer,” he added.
Villatoro Santos was charged in a federal court with ownership of illegal firearms and ordered to be delayed.
On Wednesday morning, the government submitted a short motion that seeks to ignore this case. The explanation offered is simple, but has no details. “The government no longer wants to pursue the current instant prosecution,” said the motion.
“As a terrorist, he will now face the transfer process,” Bondi said in a statement on Wednesday.

It leads to the strange state of the defendant, Villatoro Santos, asking the court not to end this case immediately.
“The dangers of Mr. Villatoro Santos are illegally deported by ICE without legal proceedings and are transferred to El Salvador, where he will almost be detained in one of the worst prisons in the world without the right to fight over his transfer,” said the two weeks delayed, both of them, in newer actions, at the time of the lawyer, his lawyer, when the lawyer, “said his lawyer, and his lawyer,” said his lawyer.
Elsayed noted that he was “very aware of the unusual nature” of the movement.
“But this is an unusual time,” he wrote, asking the court to postpone the entry of the dismissal order for two weeks to allow Villatoro Santos enough time to seek help from immigration advisers.
